Terms of Service

1. Accounts and Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

There are two types of users:

• Car Owners (Consumer Users): Individuals using the Service for personal vehicle management.
• Service Shops (Business Users): Businesses subscribing to premium features, such as directory listing and service history syncing.

2. Pricing and Payment

Car Owners

• Basic access to the Service is free.
• Advanced AI features (troubleshooting and diagnostic guidance) are usage-based. You may purchase "tokens" to consume AI features. Tokens are non-refundable except as required by law.
• Payments are processed through our third-party payment providers. You authorize us to charge your chosen payment method for token purchases.

Service Shops

• Subscription is annual and required for premium features (e.g., directory listing, premium syncing).
• Fees are due in advance. We may change fees upon renewal with notice.
• Subscriptions auto-renew unless canceled at least 30 days before renewal.
• No refunds for partial years except as required by law.

All payments are non-refundable except where explicitly stated or required by applicable law. We may offer promotions or trials at our discretion.

3. License and Use of the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal (car owners) or internal business (service shops) purposes.

You may not:

• Use the Service for any unlawful purpose or in violation of third-party rights.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Interfere with or disrupt the Service or servers.
• Use the Service to provide competitive services.
• Upload or transmit viruses or malicious code.

4. User Content and Data

You retain ownership of any data you upload or input (e.g., vehicle VIN, make/model/year, service records, notes, parts information) ("User Data").

You grant us a worldwide, royalty-free license to use, store, and process User Data to provide the Service, improve our AI models (in aggregated, anonymized form), and as described in our Privacy Policy.

You are responsible for the accuracy and legality of your User Data. We may integrate with third-party APIs (e.g., NHTSA VIN API) to enhance the Service.

5. AI Guidance Disclaimer

The Service uses artificial intelligence to provide general troubleshooting, diagnostic suggestions, and repair guidance based on user-input data and publicly available information.

You acknowledge and agree that:

• You use AI guidance at your own risk.
• We are not liable for any damage to vehicles, property, injury, or loss resulting from reliance on AI guidance.
• You should always consult a qualified mechanic for repairs.
• We make no warranties regarding the accuracy or reliability of AI outputs.

6. Intellectual Property

The Service, including all software, content, and AI models (excluding User Data), is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the Service without our permission.

7. Support and Availability

We provide email support for account and billing issues. Technical support is provided on a best-efforts basis. The Service is provided "as is" with no guaranteed uptime or service levels.

8. Termination

You may terminate your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion.

Upon termination:

• Your access ceases immediately.
• For paid subscriptions, no refunds unless required by law.
• We may delete User Data after a reasonable period.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $100 FOR FREE USERS).

10. Indemnification

You agree to indemnify and hold us harmless from claims arising from your User Data, misuse of the Service, or violation of these Terms.

11. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be notified via email or in-app notice.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of laws principles.

Any disputes shall be resolved exclusively in the state or federal courts located in Cheyenne, Wyoming. You consent to personal jurisdiction there.

13. Miscellaneous

These Terms constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect. No waiver is effective unless in writing.
